Mobile Device Specific Terms & Conditions of Sale

These Mobile Device Specific Terms & Conditions of Sale apply in addition to the Mobile General Terms & Condition and set out the basis of your purchase of Devices from us through our Website or MyRepublic App.  Please read these Mobile Device Terms & Conditions carefully, as you agree to be bound by them. In case of any conflict or inconsistency between these Device Specific Terms & Conditions of Sale and Mobile General Terms & Conditions, the Device Specific Terms & Conditions of Sale shall prevail.

1. Definitions

Definitions: Unless stated otherwise, capitalised terms used in these Device Terms & Conditions of Sale shall have the same meaning as given to them in the Mobile General Terms & Conditions, Mobile Services Terms & Conditions and Mobile Plan Terms & Conditions. Please read these Device Terms & Conditions of Sale carefully, as you agree to be bound by them when you purchase any Devices from us In addition, in these Device Terms & Conditions of Sale:

DOA: any Devices that upon your first inspection (a) does not power-up; (b) cracked screen; or (c) material defect on the Devices physical housing.

Device Billing Instalment Plan: MyRepublic in-house fixed monthly instalment payments plan for purchase of Devices.

Credit Card Billing Instalment Plan: fixed period monthly instalment payments plan available with selected credit card issuers for purchase of Devices.

2. Purchase of Devices

2.1. In order to purchase the Devices, you must be eligible pursuant to requirements set out in Clause 3 Mobile General Terms & Conditions. Device

2.2. You are responsible for the accuracy of your order. Once the order has been accepted by us, no cancellation, refunds or changes of the order shall be permitted, unless with our written consent.

2.3. You shall be responsible for any Charges associated to our acceptance of your request for cancellation, changes or refunds of order. Cancellation, changes or refund of an order shall be in accordance with the terms set out in “Cancellations, Exchanges and Refunds ” below.

2.4. Representations of Devices for sale do not constitute an offer to sell but an invitation to treat.

2.5. All orders shall be subject to our acceptance. We reserves the right to decline to process or accept any order received from you at our absolute discretion.

2.6. You agree that we may act on and process all completed electronic instructions transmitted or issued through the Website or MyRepublic App without further consent from or reference to you. We will treat your electronic order as authentic and under no obligation to verify the authority of the person issuing or transmitting such electronic order.

2.7. Prices and availability of Devices are subject to change without notice. We reserve the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we will issue a credit to your credit card account in the amount of the charge. Individual bank policies will dictate when this amount is credited to your account.

2.8. We attempt to display Devices images shown on our Website and MyRepublic App as accurately as possible. However, we cannot guarantee that the colour you see matches the Devices colour, as the display of the colour depends, in part, upon the monitor you are using. If there are accessories or furnishings included in the Devices image, they are used purely for illustration purposes and will not be included in the final sale of the Devices.

3. Payment

3.1. You will be invoiced in full immediately for the Devices upon purchase. Unless otherwise stated, all Charges for the Devices shown on the Website and MyRepublic App are inclusive of applicable Taxes.

3.2. Device Billing Instalment Plan

Device Billing Instalment Plan and its related clauses are no longer applicable for Device purchases made after 07 August 2019.

(a) Device Billing Instalment Plan plans are available for purchase of Devices to qualified MyRepublic customers. All purchases with the Device Billing Instalment Plan are subjected to the approval of the credit card issuer./p>

(b) Suspension or termination of your mobile Services will terminate the relevant Device Billing Instalment Plan associated to your purchased Device. If your Device Billing Instalment Plan is terminated, all Charges for the remainder of the Device Billing Instalment Plan period shall be immediately due and payable. For clarity, the Device Billing Instalment Plan no longer be available upon resuming Services.

(c) You must complete your existing Device Billing Instalment Plan before purchase of any new Device.

(d) To the extent permitted by law, we are not responsible for any damages or losses you may suffer if your credit card or Account is fraudulently used or used in an unauthorised manner, to purchase the Devices.

3.3. Credit Card Instalment Plan

(a) Credit Card Instalment Plan is available for purchase of selected Devices through the MyRepublic Website, by qualified MyRepublic customers. The Credit Card Instalment Plan is fully operated by the credit card issuer.

(b) Your application for the Credit Card Instalment Plan is subject to the approval of the respective credit card issuer. We will not be informed of the reason if the credit card issuer does not approve your application. You must contact the credit card issuer for the outcome of your instalment purchase.

(c) Actual monthly payments will depend on your selection of term of financing from the credit card issuer. Other bank related fees may apply to Credit Card Instalment Plan.

(d) We do not make any guarantees or warranties, express or implied, oral or written, with respect the terms or availability of the respective plans provided by the credit card issuer.

(e) No refunds will be given to purchases made with the Credit Card Instalment Plan.

(f) For clarity, changes to your Mobile Plan, suspension or termination of Services will not affect your existing Credit Card Instalment Plan, as the Credit Card Instalment Plan is a contractual arrangement between you and the credit card issuer.

(g) To the extent permitted by law, we are not responsible for any damages or losses you may suffer if your credit card or Account is fraudulently used or used in an unauthorised manner, to purchase the Devices.

(h) Please refer here for conditions, fees and charges associated with the Credit Card Instalment Plan.

4. Delivery of Devices

4.1. If your purchase is made through our Website or MyRepublic App, Devices will be delivered to you by local courier service on the delivery date selected during your Application, or on an alternative mutually agreed delivery date. We will not be liable for any unsuccessful delivery of the Devices resulting or arising from any error, omission or discrepancy in your mailing details provided by you. You will not be compensated if we are unable to deliver the Devices to you.

4.2. The Devices may be purchased and collected from our selected retail stores.

4.3. You must immediately inspect the Devices upon receipt. Upon accepting our delivery form, you shall be deemed that you have performed the necessary inspection of the Devices and accepted that the Devices are undamaged, in good working order and otherwise in a satisfactory and acceptable condition. If you choose to reject the Devices on grounds set out in Clause 6 below, you must notify MyRepublic or our representatives immediately, failing which we will not be liable for any claim of any nature whatsoever, in respect thereof.

4.4. We are not liable if you sustain any losses, expenses or damages based your inability to accept the Devices for any reason.

5. Online Order Enquiries

5.1. If you have any questions about the progress of your online order, please contact our customer service team. Please have your order number on hand handy as shown on the email confirmation.

6. Disclaimer of Warranties

6.1. The Devices are sold on an “as is” and “as available” basis. To the extent permitted by law, any warranty, condition or term concerning the Devices which might otherwise be implied or incorporated in these terms and conditions by statute, common law or otherwise is hereby expressly excluded.

6.2. We do not offer any warranty on any Devices regardless of its or their source. All Device warranties published on our Website, MyRepublic App and included in the Device are issued and granted by the respective Device manufacturer to you.

7. After Sales Services

7.1. All after sales services are directly provided by the respective Device manufacturer. You must bring the Devices to selected Device manufacturer after sales service centres to address any Devices irregularities.

8. Faulty or Damaged Devices

8.1.You may reject the Devices and request for a one to one exchange if we confirm that your Device is faulty or damaged upon your first inspection of the Device. The remedy set out in Clause 8 are the customer’s sole and exclusive remedies for faulty or damaged Devices.

9. Exchange or Refund

9.1. Following Consumer Protection (Fair Trading) Act, you may request for a refund or exchange of Device if you establish that the purchased Device was not of satisfactory quality or did not comply with the terms of purchase at the time of delivery. We reserve the right to prove (or, if the breach appears more than six (6) months after delivery, require you to disprove) otherwise.

9.2. If you wish to request for a refund or exchange, you must submit an online request to our customer service team, and return the said Device to us at designated location within seven (7) business days from our email confirmation of refund or exchange approval of the said Device. You are responsible for the cost of returning the Device to us.

9.3. We will provide a refund using your original payment mode less any outstanding Charges due to us in your Account, provided we have received the Devices in the same condition they were in upon your receipt. This means that the Devices must be returned with original packaging with all original accessories (including manuals, warranty cards, certificate of authenticity. Any and all free gifts, vouchers, accessories associated with the purchase must be returned at the same time to us.

9.4. Individual bank policies will dictate the period that the refund is credited to your account.

9.5. Delivery Charges paid is excluded from the refund.

9.6. The remedies set out in Clause 9 are the customer’s sole and exclusive remedies for non-conformity of the Devices.

10. Title and Risk in Devices

10.1. You assume all risks of the Devices when the Devices leave our premises. Title in the Devices shall remain with us and will not pass to you until we receive full payment for the Devices.

11. Intellectual Property

11.1. You agree that any and all Intellectual Property embodied in or relating to the Devices or its materials shall remain the sole and exclusive property of device manufacturer.

11.2. You must not remove or alter any trademarks, logos, copyright notices, serial numbers, labels, serial numbers or other identifying marks, symbols or legends affixed to any Devices.

At MyRepublic, we are committed to maintain the security and confidentiality of the personal information held by us. This Privacy Policy (“Policy”) describes how we look after the personal information we obtain or you provide us with when you use our Website ([insert Card Con URL]), attend Card Con, or correspond with us relating to Card Con.

1. Your Privacy

We will take reasonable care to ensure that your personal information is accurate, complete, up-to-date and stored in a secure environment, protected from unauthorised access, modification, loss or disclosure. 

2. Personal Information

a. “Personal Information” refers to your personal particulars obtained by us in the course of our dealings with you. Personal Information collected may include personal contact details, interests, comments and feedback, and communication preferences.

b. We may use “cookies” or other similar tracking technologies (“Cookies”), when you visit our Sites or use our products and services to distinguish you from other users. Through Cookies, it might also include how you use our Website to help us develop and improve our website, including details of your domain name and Internet Protocol (IP) address, operating system, browser version, cookie details, how long you stayed on a page, the route you took to navigate through the pages and the website that you visited prior to accessing our site.

c. We collect your personal information through the following means:

1. Data submitted through our web forms (including registration forms)
2. Data collected onsite during our exhibition(s), this includes personal information and activities
3. Data collected by  employees when in direct communication with persons / organisations

2. Information from actions made by an individual in response to direct marketing campaigns, including when an individual opens any emails or follows any links originating from our email communications

3. How we use Your Personal Information

a. We may collect and use your Personal Information to:
1. Provide you with information and updates relating to Card Con.
2. Respond to you in relation to any enquiries you may have
3. Produce analytics relating to your usage of our products and response to our marketing activities
4. Improving our services and user experience
And where you have opted-in:
5. Deliver targeted promotional messaging relating to our services

c. MyRepublic will not use your Personal Information for any purpose not permitted by law or beyond the stated purpose you have consented to.

d. The Card Con Website contains links to other sites. We are not responsible for the privacy practices or the content of other websites. 

4. Who do we share your Personal Information to

a. Apart from our staff, we may share your personal information with third parties to perform obligations or carry out services to us, related to the provision our products or services to you. Those entities may include:
(i) companies related to us;
(ii) our business partners, marketing partners and authorised service providers;
(iii) our professional advisors; and
(iv) our suppliers.

b. We are required to disclose your Personal Information to the parties described above so that they may carry out their obligations to us, and to you. Our disclosure of your Personal Information may, at times, be subject to their privacy policies. To every extent possible, we require these parties to act consistently with the personal information protections we have put in place.

c. We also reserve the right to disclose your Personal Information to law enforcement agencies, government regulators and our professional advisers, to the extent necessary as required by appliable laws.

d. If you post information on any of our Websites or social media platforms, any information on your post, such as your user name, may be seen by other visitors. 

5. How long do we retain your Personal Information

We retain your Personal Information for as long as it is necessary to fulfil the purposes outlined in this Privacy Policy, for legal or business purposes of MyRepublic, or as required or allowed by law. We will cease to retain such Personal Data when it is no longer required for the foregoing purposes. 

6. How you can access and update your Personal Information

a. You must ensure your listed customer details are current, complete and accurate. You may correct or update your customer details by contacting our Customer Support.

b. If you require access or a copy of your Personal Information within our possession, please contact us according to Clause 11 and we will assess your request. In some cases, we may impose a reasonable charge for making copies of Personal Information available to you. If so, we will advise you of the charge prior to making the information available to you. 

7. Withdrawing your Consent

a. You may request to withdraw your consent by contacting us according to Clause 11. Your request for withdrawal of consent will take effect within 30 days upon receipt of your request. Please note that use of your personal data may be essential for us to provide the product or service that you subscribed. Therefore, your withdrawal of consent may impair our ability to continue providing the product or service to you. Your withdrawal of consent does not affect our right to continue to collect, use and disclose personal data where permitted or required under applicable laws.

b. If you wish to withdraw your consent to receive marketing messages about our exclusive offers from us or our business partners, please contact our Customer Support or unsubscribe from our newsletter. Your request will be processed within 30 days. Non-marketing messages including product and service updates and notices will not be affected by your consent withdrawal. 

8. Protecting Your Personal Data

We take reasonable physical, technical and administrative steps to help prevent loss, misuse, unauthorised access, disclosure or modification of Personal Information. However, please understand that the transmission of data over the Internet or any other public network may be subject to loss, interception and misuse. We do not represent, warrant or undertake that your Personal Information transmitted through online means will remain secure, and disclaim all liability arising from such transmission. 

9. Overseas Transfers

We will take all steps reasonably necessary to ensure that your personal information is treated securely and in accordance with this Policy and the data protection legislation when it is processed in, or otherwise accessed from, a location outside Singapore. In order to ensure the highest level of protection. MyRepublic abides by PDPA data standards.

a. Cookies helps us to provide you with a better customer experience, when browsing our Sites. Cookies are small data files and may contain unique identifiers stored on your device by an online site. When you use our Site, we may collect standard information that is sent from your browser to our Website, including technical and statistical information.

b. You can usually choose to set your browser settings to manage Cookies. If you choose to remove or reject Cookies, you may not be able to access all or parts of our Website or services.

Card Con – Visitor Terms and Conditions

By registering for Card Con, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

1. Introduction

1.1 These Terms and Conditions (“Terms“) govern the registration and participation of attendees (“Attendees“) in Card Con by MyRepublic (“Card Con“), organised by MyRepublic (“Organiser“).

1.2 By registering for Card Con, Participants agree to comply with these Terms and the Card Con Privacy Policy.

2. Registration

2.1 Registration for Card Coins free of charge.

2.2 Attendees must provide accurate and complete information during the online registrationon the Card Con website at https://myrepublic.net/sg/card-con/ (“Website”) and must present their QR code upon registration at Card Con.

2.3 MyRepublic reserves the right to refuse or revoke an Attendee’s registration at its sole discretion.

3. Event Conduct

3.1 Attendees shall conduct themselves respectfully and follow all rules set by the Organiser.

3.2 Any disruptive, illegal, or inappropriate behaviour, including but not limited to harassment, cheating or other misconduct, may result in immediate removal from the Event.

3.3 Attendees must adhere to all venue rules and regulations.

4. Intellectual Property

4.1 Attendees shall not infringe on any third-party intellectual property rights during Card Con.

4.2 Unauthorised reproduction, distribution, or possession of copyrighted or trademarked materials is strictly prohibited.

4.3 The Organiser may take appropriate action against any Attendeefound violating intellectual property laws, including but not limited to removal from Card Con.

4.4 The Organiser disclaims all liability to the Attendees and any third parties for the infringement of laws, regulations, intellectual property rights, and venue requirements by the exhibitors, vendors and Attendees.

5. Liability Disclaimer

5.1 Subject to applicable law, the Organiser, the venue, the vendor, and the exhibitors disclaim all liability for any injury, damage or loss of any kind, including but not limited to personal injury, loss, or damage to property suffered by Attendees during the Event, even if it is caused by the negligence, omission, or fault of the Organiser, its employees, officers, agents, or sub-contractors in connection with the Website, or Card Con.

5.2 The Organiser shall not be responsible for any disputes, damages, or losses arising from transactions or interactions between Attendees, or between Attendees and the exhibitors at Card Con.

5.3 Attendees attend Card Con at their own risk and are responsible for their own personal belongings.

6. Photography and Media Release

6.1 The Organiser may take photographs, videos, or other recordings during Card Confor promotional purposes.

6.2 By attending Card Con, Attendeesconsent to the use of their likeness in such media without compensation.

7. Tournament & Prize Terms (If Applicable)

7.1 Tournament participants must follow official tournament rules and regulations.

7.2 Prizes are non-transferable, and non-exchangeable.

7.3 Any disputes will be resolved by the Organiser or its appointed vendors, and their decision will be final.

8. Amendments and Cancellation

8.1 The Organiser reserves the right to amend these Terms at any time without prior notice.

8.2 The Organiser may cancel, postpone, or modify Card Conat its sole discretion without liability.

9. Governing Law

9.1 These Terms shall be governed and construed in accordance with the laws of Singapore.

9.2 Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
